    John E. Simonett is a former associate justice of the Minnesota Supreme Court and a retired attorney. He is famous for his wit, thoughtfulness, and humor, characteristics reflected both in his judicial opinions, and in his writings and speeches. In 2007, he was named one of the 100 most influential attorneys in Minnesota history. Of his six daughters and sons, two became judges, one serving as the fourth Chief Judge of the Minnesota Court of Appeals from 1994 to 1995.

    Background
    John Simonett was born to Edward and Veronica Simonett on July 12, 1924 in Mankato, Minnesota, and was raised in nearby Le Center. He attended St. John's University in Collegeville, Minnesota, but his studies were interrupted by World War II. After three years in the U.S. Army, he was ordered to the Philippines as an infantry lieutenant just as the war was coming to a close. Upon his discharge, he returned to St. John's, graduating with a bachelor's degree in 1948. He entered the University of Minnesota Law School, where he graduated in 1951 after serving as the president of the Minnesota Law Review. He then entered private practice in Little Falls, Minnesota, with Gordon Rosenmeier. Rosenmeier was already a well-respected state senator and attorney, and Simonett soon became a well-respected trial attorney. He also became known as a colorful commentator on the law and culture, through articles such as "The Common Law of Morrison County" in 1963, which recited myths about legal rights and duties in small-town America. However, he also took on more serious and complex topics, writing an influential law review article in 1977 on the use of partial settlements of multi-defendant civil suits.[6] In 1980, when Little Falls native Walter Rogosheske retired from the Minnesota Supreme Court, Governor Al Quie appointed Simonett to fill the vacancy.

"Simonett, a moderate, wrote decisions upholding the state's fetal homicide law, overturning lower welfare benefits for new state residents and, in one controversial case, allowing a lawyer to eliminate a potential juror based on religion." Looking back on Simonett's opinions at the time of his retirement, Robert Stein (then the dean of the University of Minnesota Law School) commented that his decisions cannot readily be classified as conservative. "Rather, they seem to be very thoughtful, well-researched expositions of how prior law would apply to the case before him." In Cohen v. Cowles Media Co., his opinion for the Court reversing (on First Amendment grounds) a jury verdict against a media company whose editorial staff broke a promise of confidentiality was reversed by the U.S. Supreme Court.

    His Legacy
    In Minnesota, judges are required to retire from active service before their 70th birthday. Upon Simonett's mandatory retirement from the Supreme Court in 1994, Governor Arne Carlson appointed Paul H. Anderson, then Chief Judge of the Minnesota Court of Appeals, to take Simonett's place, and chose one of Simonett's daughters, Hennepin County District Court Judge Anne V. Simonett, to succeed Anderson as Chief Judge of the Court of Appeals. Anne Simonett's service was cut short by a brain tumor that proved fatal the following year. Another of his daughters, Martha Simonett, was later appointed to fill a District Court vacancy in Dakota County, where she continues to serve.

    The chapter of the American Inns of Court in the area of Central Minnesota in which he practiced law for 29 years has been named the John Simonett American Inn of Court.

    After retiring from the bench, John Simonett practiced law in Minneapolis until 2007, and taught appellate practice at the University of Minnesota. He continues to reside in St. Paul with his wife Doris, the former Doris Margaret Bogut.

    Died July 28, 2011 Age 87 Survived by Doris (nee Bogut), his wife of 59 years, and by five children: Two daughters, Mary Wegerson (Edward) and District Judge Martha Simonett (Gabriel Graur); and three sons, John J., Paul E. (Julie) and Luke C. A sixth child, daughter Anne (Hank Shea, now married to Chris Shea), was Chief Judge of the Minnesota Court of Appeals and died in 1995. Justice Simonett is survived by eight grandchildren: Paul (Barbara) and Sarah Wegerson, Catherine and Joseph Simonett, Henry Shea, S.J. and Claire Simonett Shea, and Tate and Robert Preston, and a great-granddaughter, Madison Wegerson. Justice Simonett was born on July 12, 1924, at a Mankato hospital and grew up in nearby Le Center. He graduated from St. John's University (magna cum laude) in 1948, with time out for military service (November 1944 - September 1946), including time in the Philippines as a 1st Lt. Inf. He graduated from the University of Minnesota Law School (magna cum laude) in 1951. He practiced law for 29 years in Little Falls, Minnesota with Senator Gordon Rosenmeier. He was State Deputy of the Minnesota Knights of Columbus (1961-62) and a Charter Member of the American Board of Trial Advocates. He served as an Associate Justice of the Minnesota Supreme Court (1980-94), following which he joined the Greene Espel Law Firm until his retirement some 10 years later. Justice Simonett was noted for his legal writing, appellate opinions and good-natured wit. Memorial Mass on Saturday, August 6, 2011, 1:30 p.m. at Lumen Christi Catholic Church, 2055 Bohland Avenue, St. Paul, MN 55116. Visitation from 12 noon to 1:30 pm at the Church.     Anne V. Simonett, whose promising legal career was cut short by a brain tumor just as she reached statewide stature as a jurist, died Saturday at Methodist Hospital in St. Louis Park. She was 42.
    She once aspired to become a concert pianist but then shifted to law, carrying over the discipline that she had applied to six hours of piano practice each day. She was sworn in as chief judge of the Minnesota Court of Appeals in July, only eight weeks before collapsing in her office.
    Gov. Arne Carlson ordered state flags flown at half-staff through Tuesday in Simonett's memory. "The state of Minnesota has suffered a great loss," he said. He appointed her a Hennepin County district judge in 1993 and quickly promoted her.
    After her cancer was diagnosed, Simonett began chemotherapy and radiation and returned to work. But she stepped down March 31 to concentrate on her family and treatment.
    "She exemplified what collegiality should mean in the judiciary. She was a really warm person you liked to talk to," said Kevin Burke, chief judge of the Hennepin County District Court. "People left her courtroom feeling she listened to them."
    Edward Toussaint Jr., who succeeded Simonett as chief judge, said: "People would say, 'She's so nice; I don't know how she can be a judge.' She would do the small things to make sure the system could be fair to the people who came into it." That included subbing on the conciliation court, which hears small claims, when it was short of referees.
    "I think the state has lost such a talent. She had such great judgment and common sense," said James Loken, who worked in the business litigation group at the Faegre & Benson law firm in Minneapolis with Simonett. He recalled attending an injunction hearing in Chicago with Simonett shortly after she was hired out of law school. "I was struck at how quickly she figured out what was going on. She was obviously a great talent as a new lawyer," said Loken, a federal Appeals Court judge.
    Simonett earned a bachelor's degree in music from Lawrence University in Appleton, Wis., and a master's degree from Yale University. Then she shifted gears, entering Harvard University, where she earned a law degree in 1981, and where she met her husband, Henry J. Shea, now an assistant U.S. attorney.
    After graduation, she spent a summer working at a New York City law firm, worked six months at Faegre & Benson in the Twin Cities, clerked for a federal Appeals Court judge in Washington, D.C., and joined a law firm there. She taught for two years at William Mitchell College of Law in St. Paul before rejoining Faegre & Benson, where she became a partner.
    She was sworn in to the Court of Appeals, replacing Paul Anderson, at the same ceremony at which Anderson succeeded her father, John Simonett, who served for 14 years, on the Minnesota Supreme Court. She was the fourth chief judge of the Court of Appeals, which was created in 1983, and the first woman to hold that position.
    Anderson said the state's court system is experiencing a loss.
    "In a very short time, she had really woven herself into the fabric of the judicial system. People really got to know and like her. She wasn't on the court long, but she was there long enough for us to see how good she was. She was going to take that court and take it up to the next highest level. She was going to be my colleague for a long time. We were going to exchange ideas. We were going to problem-solve together. I feel cheated."
    Simonett is survived by her husband; a son, Henry; a daughter, Claire, all of St. Louis Park; her father and mother, Doris, of Little Falls, Minn.; two sisters, Mary, of Shoreview, and Martha, of Rosemount, and three brothers, Paul, of Plymouth; John, of Columbia Heights, and Luke, of Oakdale.
    A public memorial service is scheduled for 3 p.m. Tuesday at Nativity of Our Lord Catholic Church, 324 Prior Av. S., St. Paul. A private funeral service for family and parishioners is scheduled for 10 a.m. Wednesday at Most Holy Trinity Church in St. Louis Park.
    In lieu of flowers, the family requests that memorials be sent to STEP (St. Louis Park Emergency Program food shelf) or the American Cancer Society Research Division.
